I recently came across something titled "California Education Code Section 35330". It is always seen on my 8-year old sister's field-trip forms, in which signing them means we agree to the terms. What is this little section of 35330? Allow me to quote a nicely hidden part of it:
"All persons making the field trip or excursion shall be deemed to have waived all claims against the district or the State of
California for injury, accident, illness, or death occurring during or by reason of the field trip or excursion. All adults taking
out-of-state field trips or excursions and all parents or guardians of pupils taking out-of-state field trips or excursions shall
sign a statement waiving such claims."So, in other words, if a teacher forgets leaves my sister in a museum bathroom and she gets kidnapped and murdered, we cannot take the teacher to trial and make them pay dearly for it.
Forgive me for saying this, but there's no better term for it- this is complete fucking BULLSHIT. I cannot believe this! The State of California is going to take away our freedom to prosecute the teachers, school officers and whatnot for any negligence they may have performed during a field trip! If we can't hold the teachers and all them responsible for their potential negligence, then why the hell are we letting them be responsible for our kids six hours a day?!
This is also putting our kids in more danger- think about it! Now that the teachers and security people and all of them don't have to worry about being sued or imprisoned or anything, so they don't have to pay as much careful attention to our youth as they should! Do we really want our kids, grandkids and siblings, our nieces and nephews put in this danger? Do we want this mandatory requirement of giving up our rights to trial wrong-doings? For what? Just so the education boards can all have their wallets safe? I say down with 35330! Don't let your kids go to field trips with this section printed on their permission slips, take them to the place yourself! At least you'll know your kid's in good hands. Bring this section up to the public, have it petitioned to be defeated! Do something!
